Berlin, February 23, 2024 <\/span><\/b>– What began in October 2021 as a position paper and DICO Talk, was deepened in a discussion proposal for the reform of Section 108e of the German Criminal Code (StGB), is now being further concretized in the form of a <\/span>Practical guide for mandate holders<\/span><\/b>. “We see the guidelines as the next important step in bringing the applicable rules of criminal law and the law on members of parliament to life in practice,” explains Professor Michael Kubiciel from the Compliance in Politics working group. “Ideally, this will prevent elected officials from becoming the focus of law enforcement agencies and the media,” adds Georg G\u00f6\u00dfwein, member of the DICO Board of Directors. <\/span> 
\n <\/span><\/p>\n

It comes with the job – elected officials perform functions, they are in the public eye and bear political responsibility. At the same time, there is the private individual with personal goals and interests. This constellation creates situations in which the suspicion can arise that individual interests also play a role in the exercise of the political mandate. What is the best way to act? How do you make the “right” decision in terms of compliance? <\/span> 
\n <\/span><\/p>\n

Under the leadership of DICO, the working group has developed a guide for precisely these cases, which is intended to help mandate holders ask themselves the right questions and give the necessary thought as part of their decision-making process. Five questions to be answered under the headings PRESS, LEADERSHIP, LEGAL, OMA and BAUCH provide initial help. <\/span>
