5 Other liability, viruses

DICO’s liability for material defects and defects of title is governed by the provisions in Section 8 of these Terms of Use. Otherwise, any liability of DICO is excluded, unless liability is mandatory, e.g. under the Product Liability Act, due to intent, gross negligence, injury to life, limb or health, due to the assumption of a guarantee of quality, due to fraudulent concealment of a defect or due to the breach of essential contractual obligations. However, damages for breach of material contractual obligations shall be limited to the foreseeable damage typical for the contract, unless there is intent or gross negligence.

Although DICO always endeavors to keep the web pages free of viruses, Trojans and other harmful proactive systems, DICO does not guarantee this.
